Perth Amboy Legalizes Tattoo Parlors, Creates Zoning

On September 9, 2024, the Perth Amboy City Council unanimously voted to support legalizing Tattoo Shops to operate as businesses in Perth Amboy. Councilman BJ Torres had introduced the reform as Tattoo Parlors were forbidden in the City. Tattooing is a popular beauty industry that generates billions in the US and shops bring economic growth to downtowns. After the second public hearing, the Perth Amboy Ordinance relating to Body Art was approved, as it helps to “encourage the development of new commercial uses with a regional appeal” in line with the goals of the City Master Plan.

Chapter 400 of the City Code now allows for Body Art Establishments in Perth Amboy, where it once was illegal for tattoo artists to operate. A $300 license must be obtained for an initial review of plans for Tattoo “Body Art” establishments and $200 fees for annual licensing inspections of establishments by the local Health Department. Zoning was also set up for the location of the establishments in the central business district. A sign must be mounted at the entrance that no one under 18 be admitted to the establishment and one sign that says Tattoo Shop or Parlor or Body Art Establishment. Murals are permitted to be painted on the establishments, per the city mural ordinance that allows for public art. No tattoo parlors can operate within 250 feet of schools or churches or 1000 feet from another shop.

Councilman BJ Torres said, “I have seen tattoo parlors drive business to downtowns like Monclair and Jersey City. I respect the art industry and have many tattoos myself. I am happy that the City Council moved unanimously to support the development of new business opportunities in Perth Amboy.”
